Terms & Conditions

  1. Client Obligations
    1. These are the Contract Terms and Conditions of all Services proposed by Celene Collins Interior Architecture & Design (now known as CCID) These form part of All Services for both Residential & Commercial Services. This contract is to be read with your personalised Fee & Service Estimate.
    2. The contract will begin upon the payment of the deposit and will run for the duration of the agreed period at the agreed total fee and based on the scope of works and phases agreed.
    3. This contract will remain unaffected by the name of your package, commencement date, duration or timeline of your project, price quoted, or amount paid or amount due.
    4. Payment/Deposit or an Instalment of the agreed Fee without signed T&C’s or a written email from you stating that you accept this contract and the terms and conditions, is also deemed as full acceptance of all that is applicable here.
    5. It is also deemed that you have read all that is included in this contract together with your fee and service proposal in full and understood it in full before proceeding. No exceptions allowed.
    6. Upon signed contract agreement, the client shall also pay a non-refundable deposit which establishes a minimum fee for all design services. This deposit will be credited against all fees payable to CCID upon completion of the project. This applies to all services and all phases, no exceptions
  2. General
    Please note the following important information for All Services
    1. CCID have strict working hours and are open Mon-Friday 9am-5pm (closed for lunch 1-2pm). Times and Days have an exception of Bank Holidays and the any Holiday Period.
    2. Our office number is 021 7011128. Our Text Only number is 087 701 3368 . Our offices are based in South Ring Business Park Cork T12HY18. Office Hours 9.30 – 5pm Monday – Friday except for Bank Holidays and Xmas Period. Our Summer closure dates are different each year.
    3. Important Update
      From 1st March 2023 CCID no longer accept WhatsApp Messaging Tool for important client communication. All images, videos or any communication are to be sent through our dedicated design platform using your own personalised login when one has been set up by you or use our dedicated what’s app number above. Other instances please use studio@celenecollins.com can be used. Always expect 24 -48 hours for a response via email. These steps are an essential part of our client communication due to the large volume of projects that we work on. This helps CCID to track design concepts, discussions and ideas shared between both parties. If you have any queries regarding this, please discuss with CCID.
  3. Services
    1. These Terms & Conditions are applicable to all CCID packages and are not restricted to the services noted or not noted in this document. Please refer to your own Fee Estimate for deliverables unique to your project and what you have paid for and what has been outlined to us as part of your requirements & formed part of your agreed Scope. Please ensure that we have understood your needs correctly, ask before signing don’t assume anything.
    2. The start of all our Services is a one off consultation. It is a Professional Service that does not include specific links or drawings. It is suitable to clients who are looking for design ideas and a steer in the right direction but it is understood Client will do all the leg work. At this stage is it also where CCID can gain further understanding of your needs should you wish us to offer a new package by way of a Service & Fee Proposal.
    3. CCID also offer Room Makeover Packages that are suitable for single or multiple simple room makeovers. Refer to our eDécor Packages for details on our website. These are to be paid in full before commencement, are 100% on line. Suitable for 1 or more full room makeovers that have no structural changes and have smaller budgets to work with. There are shopping links included but clients must be happy to install all the room themselves & over see purchasing and deliveries. CCID can provide How To Guides as part of the package. You can not change in the middle of an eDecor Package to a full service package, there will be not refund.
    4. We offer a Premium Luxury Interiors Service for higher end needs called Finishing Touches Package. This is a Premium Service that offers luxury high end branded products. In all Cases this Interiors Package can operate on it’s own or alongside a Premium Interior Architecture Service, but is priced separately. All Delivery costs, skipping of old materials, recycling of packages, hiring of vehicles for transportation are not included and are priced separately. Any delays due to difficulty with access will incur additional charges. Installation by CCID together with Project Co- ordinate carry a separate costing and is not included unless your Quote states it does.
    5. If you have selected a Premium package i.e Interior Architecture & Design, Detailed Drawings, Floor Plans , 3D Rendering, Please note that there is an agreed scope to be signed off prior to commencement. Your quote must be accepted on line via the quote link, and if there is a change of mind ** or a change to the scope ** each will require a seperate sign off each time there is a change. No exceptions.
    6. In most cases it will be your first time ever hiring an Interior Design & Architecture Company so it is important not to make assumptions.
    7. Options will have been discussed with you and it is important that you are 100% happy with the package you chose from either a Tailored Package or One-off Consultation or eDécor Package or ny of our Premium Services, and that it fits with your needs and expectations and the scope required.
  4. Services Expectations & Deliverables
    1. It must be noted that all drawings & sketches & elevations shared with you across All Services will be without measurements. These are conceptual drawings only to demonstrate ideas, and to be used for virtual images or to demonstrate styles, scale and if a design idea works in your space visually, to assist in getting quotations from relevant trades.
    2. If unique measured CAD drawings are required for joinery purposes, they must be requested or agreed that they form part of you project separately from CCID, as extra charges do apply before they will be issued. All invoices must be up to date to allow these to be issued.
    3. They are not to be used for construction purposes, the Joiners/ Fitters are liable for what they build themselves and must take their own measurements before ordering any materials no responsibility will be taken for errors or omissions in this regard. No responsibility will be taken whatsoever in relation to any changes that your contractor makes after Phase 1 has been completed with CCID. It is your responsibility to manage your own project after the point of drawings handed over unless we are appointment as Project Co-ordinators.
    4. It is the responsibility of you the Client, not CCID to ensure that it is always accurate measurements and the most up to date drawings that we are working from. At no point do we engage with the Architect or Engineer or Contractor on your behalf to ensure accuracy of your drawings.
    5. New Builds /Renovations : Before beginning a Project we must receive the .dwg plus PDF versions of up to date drawings, extra charges may apply if we are to create new floor plans from pdf docs only.
    6. All payments must be brought up to date before we will issue any final documents or images together with details on finishes or design materials
    7. All such dates shall be approximate and CCID cannot be held responsible for delays that are outside of their control. It will always take longer than expected and there is a good chance that due to your own choices along the way that the project will end up costing more than you had planned.
    8. The Client shall ensure that they are clear and concise in their agreement on design decisions and no delays /numerous changes and revisions are to take place when making decisions to avoid design revisions as these will incur extra costs and add delays to the installation phase
    9. One person in a couple or family is to be allocated as the Signee (to sign off on agreed decisions using the Design Platform)
    10. One email address only will be used in all correspondence from CCID. It is the responsibility of the recipient, the email owner to share and discuss with relevant other parties, it is not the role of CCID & CCID take no responsibility for lost emails.
    11. Where is it is necessary CCID will use email over the platform, for communication and appointment purposes, sharing Zoom Links etc… only
    12. Please ensure a New Email Thread is used to avoid long time consuming searches through emails. Fill in subject lines with clear headings such as Bathroom or Kitchen … so that CCID & Client can all easily search to find information.
    13. One person / One Email address to be allocated to sign off designs and drawings. This should be agreed at the start of the project with CCID. A new project email should be created by clients for the duration of the project that clients can keep up to date with correspondence.
    14. If Communication from CCID is initiated through the Design Platform please respond only through the platform. If email is used to Communicate , please respond to that email via email using the same email address.
    15. IMPORTANT Where CCID are appointed as Project Co- ordinators, at no time can CCID be held responsible for actions or delays of the Principle Contractor. Client ‘s will be their own Project Managers as they control the payments to the contractors.
    16. CCID will only act in an advisory capacity at all times, CCID will will not be deemed to be Managers of the project as it is near impossible to be on site 24 -7, 5 days a week and as payments are paid directly to the contractors & the sub-contractors
    17. CCID will not under any circumstances be responsible for any changes to the agreed scope that are not discussed and agreed beforehand
    18. If new additions or changes to the Design/Scope that was agreed are altered directly with Trades on site CCID & consistently not advised, CCID are well within their rights to withdraw from the project with out notice, due to a break in the agreed terms and conditions.
    19. All instructions are to be advised CCID to ensure programme efficiency. We accept no responsibility for errors or omissions from changes to the design that are made that are not advised directly from clients to CCID
    20. Client meetings mean Client Meetings BOTH parties MUST be at ALL Design & Client Meetings, in person or via video link – No exceptions
  5. Exclusions:
    These following exclusions apply unless otherwise stated & agreed directly with you , as part of your agreed phase and project type

    • Excess of 2 Revisions for Concepts per room
    • Excess of 1 Final Room Full Design
    • Tailored Shopping List (Furniture & Accessories ) with direct links
    • Excess of 3 revisions for Shopping List (F & A )
    • 3D Rendering All Formats
    • Videos & Walk Throughs of room/s
    • Finishes List ( e.g. Tiles, Flooring, Lighting )
    • Quantities and Quotes for Supply and or Fit
    • Project Consultants/Co-ordinators over Installation of any / all Works
    • Excess of 2 Site Meetings
    • Instructions to Principle Contractor on clients behalf
    • Collection & Deliveries
    • Interior Selections
    • Turnkey Service
    • Payments to suppliers on your behalf
    • Budget Control
  6. Consultants & Contractors:
    1. CCID are not General Contractors and will not act in such capacity. Any issues or instructions concerning construction elements must be discussed and instructed between the owner and his/her Principal Contractor, Engineers, or Architect. CCID will not provide a warranty, guarantee, or certification of said parties part of the project and neither will CCID be responsible for the quality of said parties works, materials used, their performance, nor their duration of works. However, the CCID will supervise them for conformity to CCID design concepts where Project Management has been agreed to as part of the package.
    2. The contractor must accept our role as project directors and work in partnership at all times,. The must report any changes, updates in time lines, materials, delays or changes. CCID will not accept any liability, errors omissions in relation to contractor communications
    3. Where applicable and where CCID have also accepted the appropriate fee & package type to over see and manage the Budget on the client’s behalf, CCID will be the only point of contact for the client. All details and designs, engagement of Trades and work schedules remain the management responsibility of CCID. The scope of work for this phase 2 must be agreed and signed off before commencement of the project, where CCID are also contracted as Project Directors , strict rules apply to scheduling and changes that are not part of the agreed scope. If there are additions to the agreed scope, this must only be added to the end of the timeline to avoid delays in scheduling.
    4. All such dates shall be approximate and CCID cannot be held responsible for delays that are outside of their control. No exceptions
    5. The Client shall ensure that they are clear and concise in their agreement on design decisions and create no delays when making decisions to avoid design revisions, this results in additional time being used up and in the end incur extra costs.
    6. CCID have many close ties with Services & Trades. Should CCID recommend such services to the client CCID do not accept any liability for errors or omissions or any liability in relation their processes.
  7. Scope of Works Explained:
    1. A room by room list will be written up by you and provided to CCID. This list forms your Scope, It focuses on areas of each room that are included and form part of the project design. We will discuss this list at the initial meetings and advise how to define the areas for you.
    2. The list is final. If it changes additional costs will be set against the changes and it’s result. Remember alongside changes in cost i,e labour & materials there is additional valuable time from CCID Simply put If more items and work it is added to the scope and overall design then this will incur an extra fees and will be deemed as a revision. Here is an example of this. You set out to keep the floor and the fire place in your living room, designs are created, scheme developed and agreed around keeping the existing floor and the fire place.
    3. If you change your mind after the Scope has been agreed and the Concepts that were offered are now to be changed – this is classed as a revision. CCID will need to adjust the Fee as new drawings and concepts need to be drawn up.
  8. Finishing Touches Luxury Interiors
    1. CCID has formed close relationships with interior distributors in UK and Europe over our 20 years in business. When we are sourcing suitable products for clients, we will include a selection of these products and finishes as they offer the client the best possible options inline with style and budget that would not be available otherwise to the client.Interior Finishing Touches can include:
      • Art,
      • Lamps
      • Curtain making & Trims
      • Accessories
      • Rugs
      • Wallpaper
      This is an additional service and a mark up is applied to these trade items in the same way as if you purchased them from any where else.
      If you also wish CCID to install them this must be priced separately as it’s Professional Service
    2. In such cases, full payment of the agreed purchase price is required from the Client prior to ordering/purchasing the agreed products.
    3. As good purchased through Trade accounts on behalf of the client cannot be physically seen or touched by the client, the client agrees that the Designer is familiar with the size and the quality of the item, and it is deemed suitable for both the client’s budget and the style that the client wishes to achieve.
    4. Once goods have been ordered for the client, unless the goods are damaged there is no return or refund if the client doesn’t like it or has a change of mind.
    5. If the goods are damaged the Designer must be informed immediately and the goods delivered/returned to the CCID office without delay.
    6. Only those items bought solely through CCID under their trade relationships/accounts will be the full responsibility of CCID.
  9. Refunds:
    Once furniture or furnishing items have been ordered from vendors, most items bought cannot be returned. Customised and specially produced items cannot be returned. Additionally, because CCID have been paid, these remain non- refundable even if the purchased items are returned.
  10. Contractual Relationship
    The client contractual relationship is solely with Third Party suppliers and the Client will be responsible for managing these relationships and any financial settlements direct with Third Party suppliers. CCID are not responsible for any delays that occur in the timelines between Trades and Clients and delays in the delivery of any aspect of their project. CCID are not responsible for forming any new contractual relationships on behalf of the client entered into the design or scope, after the beginning of a project. CCID cannot guarantee prices of merchandise, interior installation, or other services not performed by CCID, because pricing can be subject to change due to situations outside of their control. If a client is indecisive or unsure and takes longer than is necessary to make a final decision, a vendor’s / contractors change in price is out of the CCID’s control. The client is not entitled to use direct contact, on any new design matters relating to the project, revise any concepts directly, revise any colour schemes or discuss or revise drawings that have already been signed off prior with CCID with any Trade or Profession on site throughout the process of the project.
  11. Payment and Billing terms
    1. The charges for the service are set out in the proposal accompanying these terms and conditions or as amended/updated by CCID and communicated to the client. If the scope of works is amended this will immediately impact the project and will result in an adjustment to the fee in the proposal with immediate effect.
    2. Payments must be made online by bank transfer. Where payments are international, CCID do not accept any additional bank charges that occur and this will be passed back to the client as an adjustment fee.
    3. Bank details are outlined on our invoice. When making the payment online the details should be accompanied by the Invoice Number. Not quoting the Invoice Number may result in an invoice reminder being generated incorrectly and/or delay to the ordering of any material or pieces of furniture.
    4. All payments to CCID, are due immediately upon presentation of invoice, except where otherwise agreed. All work and deliveries will be stood down until payments are brought up to date.
    5. Your Interior Architecture Phase 1 will never run concurrent to your build. It is agreed as part of these terms that Phase 1 is to be completed in full prior to work commencing regardless of a Principle Contractor being involved or not
    6. While CCID do not charge you an hourly rate unless other wise been stated. We do carefully considered your scope and the project details provided by you. Your fee is calculated based upon of a number of factors, including but not limited to; time required based on input from Celene Collins Senior Designer, Junior Designer, CAD drafters, 3D drafter. Anticipated and planned for number of revisions, the Design Time required based on complexity and detail. travel/distance , over run on the number of revisions and or vrisits due to a change of scope/ access / delays ill vary from Designer from 50 – 150 per hour
    7. Email correspondence, project duration, possible lengthy delays caused by slow decision making or changing one’s mind, number of site visits, roles and responsibilities, delays by builders, the stakeholders, value of the overall budget, detail and complexity of designs and the overall project management.
    8. The result is your fee and payment terms.Payment Terms – Refer to your tailored package.
    9. Deposits or Instalments made are not the same as performance output. Please respect and value our time and the Professional Services that we offer. We have spent many years building up our reputation in our industry and it should be understood when accepting these terms and conditions that client takes them seriously and respects all aspects of our services. Should CCID have to instruct a debt recovery agency, or instigate legal proceedings, the client will be liable for any costs incurred.
  12. Terminations and cancellation policy:
    1. CCID has the right to exercise the right of cancellation. CCID must give written notice to client via email to client. The client has the right to exercise the right of cancellation. Cancellation notice must be communicated by email to studio@celenecollins.ie
    2. Once the client has notified CCID that they are cancelling their contract with their reasons, CCID will reserve the right to discuss those actions via email with the client before agreeing to warrant any refund.
    3. A delay by either party in acting on a breach of this contract will not be regarded as a waiver breach. If either party waives a breach of the contract by the other, the waiver is limited to the particular breach.
    4. Termination of contract will not affect either party’s outstanding rights or duties, including CCID rights to recover any money owed under these terms and conditions.
  13. Liability
    1. CCID shall have no Liability to the client for any loss, damage, costs, expenses, or any other claims of compensation arising from any information or instruction supplied by the client, which is or are incomplete, incorrect or inaccurate.
    2. CCID shall not be liable to the client for any unforeseeable loss or damage arising from the provision (or non-provision) of the Services, including loss of profit or consequential loss or damage.
    3. Neither CCID nor the client shall be liable for any failure to perform its duties under this Contract due to circumstances out of their control, including without limitation to flood, fire, or Covid 19 related closure or otherwise adverse weather conditions. To enable CCID to deal with any complaints that may arise relating to the Services, the client must provide full details of the complaint within seven days of supply of the relevant service.
    4. Nothing in these terms and conditions affects any liability for death or personal injury caused by CCID negligence or for fraudulent misrepresentation or the clients right as a consumer.
  14. Data Protection
    1. CCID will not use any personal information provided by the Client for any purpose.
    2. We have taken every measure to prevent internet fraud and ensure data collected from you is stored as securely as possible. However, we cannot be liable in the event of a breach in our secure computer servers.
  15. Copyright
    1. In the copyright design right and all other intellectual property rights in any materials and other documents or items prepared or produced for the client by or on behalf of CCID in connection with the services shall belong to CCID absolutely, and any such materials, documents or items shall be or remain the sole property of Celene Collins Interiors & Design.
    2. CCID shall be permitted to use photographs of the Clients property which demonstrates the Services provided by CCID for its own marketing purpose.
    3. The client shall be entitled to use any such materials, documents, or other items as referred to in connection with the services but shall not be entitled to copy such items or use them for any commercial purpose.
    4. In accessing the Design Platform, you agree that you will access the content solely for your personal, non-commercial use. General
    5. CCID, may assign or sub-contract the Contract if this is necessary for operational reasons or in connection with a business transfer or reorganisation. Otherwise, the contract is not transferable by either party.
    6. These terms and conditions and the Contract will be subject to Irish Law and the Irish Courts will have jurisdiction in respect of any dispute arising from the contract.
    7. Before handover of a completed project to the client, it will be understood that CCID will require access to all rooms to photograph or video regardless of CCID providing the furniture and accessories for client communication and marketing purposes.
    8. A professional photographer may be used in some cases and CCID will be allowed to stage the rooms applicable.
    9. CCID retains the ownership of its interior design concept,copyrights, sketches, plans and 3D drawings, sales swatches, intellectual property, rights and any other materials prepared for the project. Client does not have the right to share or use the design for any other project except the said one entered into without the explicit written permission of the interior designer.

Formation of Contract

  1. These are Terms and Conditions of our Services proposed by Celene Collins Interiors or CCID. These form part of the services as set out in your attached Fee & Service Proposal and are to begin upon the agreed date for the duration of the agreed period at an agreed fee based on the requirement needs.
  2. CCID terms as stated here, and will remain unaffected by the Name of your Package, Commencement Date , Duration or Contact agreed with you and your principle contractor.
  3. All terms outlined applicable to your chosen service with Celene Collins Interiors, ( CCID ) and you (the Client) will apply with acceptance of these T&Cs in writing or are also deemed acceptable by receipe of the 1st instalment paid
  4. Payment deposit or an instalment without signed T&C’s or a confirmation email that you accept these T&C’s, is also deemed a full acceptance of all that is applicable here and that you fully understand the T&Cs before payment and are happy to proceed.
  5. To ensure that you fully understand, please read the terms and conditions carefully outlined below.
  6. These T&Cs are applicable across all our services regardless of your type of service/package/duration or price quoted.

CCID-Design & Scope of work

  1. CCID, have been retained to provide a one off service or a tailored package especially for your needs, requirements and budget.
  2. There will have been options discussed with you to include or exclude some services that we offer, and it is important that you are 100% happy with the tailored package offered to you. What it includes and doesn’t include and that it fits your needs. However, we are happy to price and include any additions charges as the project evolves. Please see Exclusions that apply
  3. CCID T&C’s forms part of any 1. one-off e-design 2. tailored flat fee services 3. Furniture Rental 4. Home Staging and must be read in conjunction with your individual fee proposal which will be sent to you separately.
  4. These following exclusions apply., Unless otherwise stated that they are included in your estimate – Vat, Project Management,, Installation of any works, Elevations , 3D Rendering images or videos, All types of CAD measured drawings, CAD Floor plans, Shopping lists , Excess of 3 revisions
  5. CCID are not general contractors and will not act in such capacity. Any issues or instructions concerning construction elements must be discussed and instructed between the owner and his/her Principal Contractor, Engineers or Architect.
  6. The Scope is outlined and agreed to before the project begins if changed there will be subject to additional costs in addition to those in your Fee Proposal. (Costs will be notified in advance before proceeding).
  7. CCID will endeavour to advice the client of the predicted timescale of works (Phase2 if applicable). All such dates shall be approximate only and Celene Collins Interiors & Design cannot be held responsible for delays that are outside their control.
  8. CCID role (If Phase2 is applicable to your service) is to co-ordinate Third Party services , firms or individuals (Third Party suppliers) to undertake certain work for the client, such as decorating, building work, carpet fitting, curtain and blind manufacturing and fitting and other such work as confirmed by CCID and as agreed to in the Scope of Works that form part of your Estimate. If phase 2 begins ahead of what has been recommended it may cause delays for builders in lead times especially Tiles & Sanitary Ware , Flooring & Furniture as these are not kept as stock items in shops at all times and may need to be ordered.
  9. Espically when using e-design services note the following important information.CCID have strict working hours and are Mon-Friday 9am-5pm (closed for lunch 1-2pm) with the exception of Bank Holidays. Most appropriate contact method is via email or phone call to speak directly to the Designer. Please do not leave voice mails, What’s App or Text messaging services as these are not deemed appropriate in relation to Design Matters. No guarantee can be made if instructions are delivered in ways other than an email.

E-Design Services/ Online or Remote Consultations & Personal Shopping LIsts

  1. Please provide as much detail in your Questionnaire and specific information along with photos so that our design package can match your requirements & to avoid disappointment. Sometimes we may have to clarify information with you., and will need to submit further Questionnaires. Please respond as quickly as possible to any clarification requests as failure to do so will result in your design taking longer.
  2. Our Questionnaire must be completed in full as it gives us a very good idea of your likes, dislikes and requirements which we need to know to fulfil your requests.
  3. Because interior design is such a personal and subjective service, it may arise that you do not like a particular element of your design. To ensure we understand your style, it is important that you answer the questionnaire as truthfully and with as much detail as possible. If this happens, we are happy to revise the concept, but we cannot completely re-work a design or refund payment or part thereof. Open plan spaces are considered to be multiple rooms for the purpose of our Interior Design Virtual/Online Services e.g., the design of an open plan kitchen , dining and living room will be charged on the basis of three rooms and may require a separate questionnaire for each room -if desired.
  4. The price and availability of each product etc. Will be accurate at the time of completion of your design. We cannot however guarantee the price or the availability of any item over time. We recommend that you order your items as soon as possible once your design is received to avoid disappointment. We can only recommend an alternative item in this instance. We will always offer items under our partnerships as these have taken a long time to build up so that we can offer a personal shopping experience to our clients. It is these items that are purchased through ourselves come under our responsibility and cannot be returned unless they are damaged as they have been specially selected for you under our Personal Shopping Service and style and quality have been matched especially for you.
  5. Prices for products and furniture do not include delivery or assembly unless otherwise stated. We do not procure or arrange delivery of items nor do we any responsibility for the condition or the quality of any goods or furniture that are ordered through third party suppliers.
  6. We do not include the cost for labour in our schemes, e.g., painting, wallpapering, laying of fillers, fitting lights, fabrication of curtains etc… we also do not include for material or tools required to carry out such tasks, e.g., wallpaper paste, wall filler, tools etc in the Design Boards.
  7. We are happy to provide you with a list of tried and trusted trades that can carry out any work for you should you decide to over-see the makeover yourself. We cannot always guarantee the exact colour of a product or finish due to the quality of brochures difference in web browsers etc. For wallpapers, furniture etc. We recommend that you view the product in-store or request a sample of your product or finish before you purchase it, if you have any concerns.
  8. We always recommend you test a sample of all paint colours before you use as they can vary considerably depending on underlying colour, natural light etc.

Client Obligations

  1. The Client shall ensure that the property is accessible to Trades that form part of the project under the project management role of CCID, and any other third-party suppliers providing services throughout the duration of the works.
  2. The client will ensure that utilities such as electricity and water are available for use at the property throughout the works and will no cost to CCID.
  3. No additions or changes to the Design/Scope are to be discussed or added with Trades on site. All instructions are to go through CCID to ensure programme efficiency. The client is to ensure they are satisfied with all design matters that will be signed off by one-party to CCID.

Purchasing of Products

  1. 1.As part of the scope CCID may be required to purchase products for the client from TRADE ONLY accounts in addition to the scope of work already proposed. In such cases, full payment of the agreed purchase price is required from the Client prior to ordering/purchasing the agreed products. Credit card charges may apply for certain credit card payments to cover.
  2. As selection of goods bought through Trade accounts cannot be physically seen or touched before selected, they are hand selected and for the client as the Designer is familiar with the size and the quantity of the item and it is deemed suitable for your style and budget. Once delivered, and unless the goods are damaged there is no return or refund, if you don’t like it or have a change of mind. If the goods are damaged the Designer must be informed immediately and delivered/returned to our office without delay.
  3. As part of our role we will help the client source suitable furniture in line with the agreed style and budget etc… These items that are ordered and paid for by the client will remain the responsibility of the client CCID are not responsible for any omissions in the delivery process/delivery, problems arising over delays, breakages etc.
  4. Any delays or issues around CCID being available to for these items bought directly outside the pre-agreed. For the designer this is included in part of the Estimate.
  5. Only those bought solely through CCID under their trade relationships/accounts will be the full responsibility of CCID.

Contractual Relationship

  1. The client contractual relationship is with Third Party suppliers and will be responsible for managing these relationships and any financial settlements direct with Third Party suppliers.
  2. If so required CCID may coordinate the services and financial settlements with the Third-Party suppliers on their behalf, as part of their service undertaken, but the client will remain ultimately responsible for the contractual relationship with the Third-Party supplier.
  3. CCID is not responsible for forming any new contractual relationships on behalf of the client entered into the design or scope after the beginning of the project.

Payment and Billing terms

  1. The charges for the service are set out in your Proposal accompanying these terms and conditions or as amended or updated by CCID and communicated to the client. If the scope of works is amended this may immediately impact the works and will result in an adjustment to the fee in the proposal with immediate effect.
  2. If paying by Cheque these should be made payable to Celene Collins Interiors & Design or payment can be made online by bank transfer or payment can also be made by personal debit or credit card. (This is subject to additional transaction charges)
  3. Bank details are outlined on the invoice. When making the payment online the details should be accompanied by the INVOICE NUMBER. Not quoting the invoice number may result in an invoice reminder being generated incorrectly and/or delay to the ordering of any material or furniture pieces.
  4. All payments to CCID, are due immediately upon presentation of invoice, except where otherwise agreed.
  5. Should Celene Collins Interiors have to instruct a debt recovery agency, or instigate legal proceedings, the client will be liable for any costs incurred.

Terminations and cancellation Policy

  1. The client has the right to cancel this contract at any time up to the end of seven working days after the day on which Celene is issued.
  2. To exercise the right of cancellation the client must give written notice to CCID via email to info@celenecollins.com
  3. Once the client has notified CCID that the client is cancelling their contract with their reasons, CCID will reserve the right to discuss those actions via email with the client before agreeing to warrant any refund.
  4. A delay by either party in acting on a breach of this contract will not be regarded as a waiver breach. If either party waives a breach of the contract by the other, the waiver is limited to the particular breach.
  5. Termination of contract will not affect either party’s outstanding rights or duties, including Celene Collins interiors rights to recover any money owed under these terms and conditions.

Liability

  1. Celene Collins Interiors shall have no Liability to the client for any loss, damage, cost, expenses or any other claims of compensation arising from any information or instruction supplied by the client, which is or are incomplete, incorrect or inaccurate.
  2. Celene Collins interiors shall not be liable to the client for any unforeseeable loss or damage arising from the provision (or non-provision) of the Services, including loss of profit or consequential loss or damage.
  3. Neither Celene Collins Interiors, nor the client shall be liable for any failure to perform its duties under this Contract due to circumstances out of their control, including without limitation to flood, fire, or Covid 19 related closure or otherwise adverse weather conditions.
  4. To enable Celene Collins Interiors to deal with any complaints that may arise relating to the Services, the client must provide full details of the complaint within seven days of supply of the relevant service.
  5. Nothing in these terms and conditions affects any liability for death or personal injury caused by Celene Collins interiors negligence or for fraudulent misrepresentation or the clients right as a consumer.

Data Protection

  • Celene Collins Interior & Design will not use any personal information provided by the Client for any purpose.
  • We have taken every measure to prevent internet fraud and ensure data collected from you is stored as securely as possible. However, we cannot be liable in the event of a breach in our secure computer servers.

Copyright

  1. In the copyright design right and all other intellectual property rights in any materials and other documents or items prepared or produced for the client by or on behalf of Celene Collins Interiors & Design in connection with the services shall belong to Celene Collins Interiors & Design absolutely and any such materials, documents or items shall be or remain the sole property of Celene Collins Interiors & Design.
  2. Celene Collins Interiors & Design shall be permitted to use photographs of the Clients property which demonstrates the Services provided by Celene Collins Interiors & Design for its own marketing purpose.
  3. The client shall be entitled to use any such materials, documents or other items as referred to in 10.1 in connection with the services but shall not be entitled to copy such items or use them for any commercial purpose.
  4. In accessing the website you agree that you will access the content solely for your personal, non-commercial use.

General

  1. CCID, may assign or sub-contract the Contract if this is necessary for Operational reasons or in connection with a business transfer or reorganisation. Otherwise the contract is not transferable by either party.
  2. These terms and conditions and the Contract will be subject to Irish Law and the Irish Courts will have jurisdiction in respect of any dispute arising from the contract.
